This Cancellation and Refund Policy applies to all digital products, live seminars, recorded seminars, online courses, and any other products or services offered by Addison Chiropractic & Kinesiology PLLC, doing business as Applied Kinesiology Online (appliedkinesiologyonline.com) and Dr. J.J. Gregor DC (drjjgregor.com).

Refund Policy

All refund requests must be submitted in writing to: [email protected]

Digital Products Only

For products that are entirely digital (online courses, video libraries, digital textbooks, downloadable materials):

  1. Full refund (minus 10% administrative fee) if:

    • No portion of the digital content has been accessed in any manner, AND
    • Student requests refund within thirty (30) days from purchase date
  2. No refunds after:

    • Any digital content has been accessed in any manner, OR
    • Thirty (30) days from purchase date
  3. No refunds for Kindle books, e-books, or other non-returnable digital formats

  4. For physical materials (books, study guides, CDs, DVDs, kits):

    • Must be returned unopened and unused at student's expense
    • Physical materials already opened or used are non-refundable
    • Additional restocking and shipping fees apply

Live Seminars Only

For seminars or courses that are live events with no digital component:

  1. Full refund (minus 10% administrative fee) if:

    • Written notification received at least 72 hours before the seminar start time
    • Example: For a Saturday 9 AM seminar, notification must be received by 9 AM Wednesday
  2. Single-weekend seminars:

    • No refunds after the 72-hour cancellation window
  3. Multi-weekend seminar series:

    • No refunds after the first weekend session ends
    • To qualify for partial refund: Written notice must be received within 72 hours after the first session ends
    • Partial refund calculation: Total paid minus 10% admin fee minus cost of first session

Live Seminars with Digital Support (Combo Products)

For seminars that include both live attendance and digital materials (recordings, notes, video access):

  1. Full refund (minus 10% administrative fee) if:

    • Written notification received within 30 days of purchase, AND
    • At least 72 hours before first live session, AND
    • No digital content has been accessed
  2. No refunds after the earliest of:

    • Digital content has been accessed, OR
    • 30 days from purchase, OR
    • 72 hours before first live session
  3. Multi-session series with digital support:

    • No refunds after first live session ends
    • To qualify for partial refund: Written notice within 72 hours of first session closing
    • Partial refund calculation:
      • Total amount paid
      • Minus 10% administrative fee
      • Minus digital product value
      • Minus cost of the first live session

Retake Enrollments

For students retaking previously completed courses:

  1. Retake enrollments are heavily discounted (typically 50-66% off standard pricing)

  2. No refunds after the earliest of:

    • 30 days from purchase, OR
    • First session begins
  3. No exceptions due to significant discount already applied

Administrative Fee

All approved refunds are subject to a 10% administrative fee deducted from the refund amount, calculated based on the total purchase price.

Terms and Conditions

Acceptance of Terms

By accessing or using Applied Kinesiology Online services, you accept and agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.

Definitions

  • "Client," "You," "Your" refers to the person accessing this website or purchasing services
  • "Student" refers to any Client enrolled in a course, seminar, or educational service
  • "Company," "We," "Our," "Us" refers to Addison Chiropractic & Kinesiology PLLC
  • "Services" refers to all courses, seminars, products, and materials offered
  • "Digital Content" refers to online courses, videos, recordings, PDFs, and downloadable materials

License and Intellectual Property

  1. Unless otherwise stated, Addison Chiropractic & Kinesiology PLLC owns all intellectual property rights for materials on Applied Kinesiology Online

  2. You may access materials for personal use only, subject to these restrictions:

    • You must not republish, sell, rent, or sub-license our materials
    • You must not reproduce, duplicate, or copy our materials for distribution
    • You must not redistribute our content to third parties
  3. Course materials, videos, and recordings are licensed for individual use only

  4. Sharing login credentials or distributing course materials is prohibited and may result in account termination without refund

  5. Recording and Photography Prohibition:

    • Recording (audio or video) of live seminars is strictly prohibited without prior written consent
    • Photography of course materials, slides, or demonstrations is prohibited
    • Screenshots or screen recordings of digital content are prohibited
    • Posting course materials to community drives, file-sharing services, social media, or any online platforms is strictly prohibited
    • Selling, distributing, or commercially exploiting any course content is prohibited
    • Violations may result in immediate account termination, legal action, and liability for damages
  6. Teaching Restrictions:

    • Course content is for personal professional development only
    • Teaching Applied Kinesiology professionally requires Diplomate certification through ICAK
    • While we cannot prevent independent use of general techniques, reproduction of our specific course structure, materials, or proprietary methods is prohibited

Account Termination and Violations

  1. We reserve the right to immediately terminate access to courses and materials without refund if you:

    • Share login credentials with others
    • Violate intellectual property restrictions
    • Record or distribute course content
    • Engage in fraudulent activity
    • Violate any terms of this agreement
  2. Account termination for violations forfeits all access and payments with no refund

  3. Chargebacks and Payment Disputes:

    • Initiating a chargeback through your credit card company instead of following our refund policy constitutes breach of contract
    • Chargebacks filed after receiving services or accessing content may result in:
      • Immediate account termination
      • Forfeiture of all course access and materials
      • Collection efforts for amounts owed
      • Legal action for breach of contract and recovery of costs

Payment Terms

  1. Payment Processing: Payment is due in full at time of enrollment unless payment plan is specifically arranged

  2. Payment Plans: If payment plan is arranged:

    • Terms must be agreed to in writing
    • Missed payments may result in suspension of course access
    • Full balance must be paid before certificate of completion is issued
  3. Failed Payments: If automatic payment fails:

    • You will be notified via email
    • Access may be suspended until payment is resolved
    • Additional administrative fees may apply
  4. Certification Eligibility: Certificate of completion will not be issued until all payments are received in full

Certification and Completion Requirements

  1. Attendance Requirements:

    • Students may miss no more than one (1) session to qualify for certification
    • Missing more than one session disqualifies student from receiving certificate
  2. Written Examination:

    • Students must pass the written examination administered in Session 7
    • Passing score and criteria determined by instructor
  3. Re-examination Policy:

    • Students who fail the written examination may retake at:
      • A future Session 7 of another course cycle
      • An ICAK meeting where testing is offered
      • Individual arrangement with instructor
    • Re-examination fees apply and must be paid in advance
  4. Certificate Issuance:

    • Certificates issued only after:
      • All attendance requirements met
      • Written examination passed
      • All payments received in full
  5. No CE Credits: This course does not provide Continuing Education credits. Students are responsible for determining if this course meets their individual licensing or continuing education requirements.

Professional and Medical Liability

  1. Course content is for educational purposes only and does not constitute medical, diagnostic, or treatment advice

  2. Students are solely responsible for:

    • Determining applicability of techniques to their practice
    • Complying with their professional licensing requirements
    • Their own clinical decision-making and patient care
    • Any outcomes or consequences from applying course techniques
  3. Clinical Application Disclaimer:

    • We are not liable for any injuries, adverse outcomes, or consequences resulting from your application of course techniques
    • You assume all risk and responsibility for techniques used in your practice
    • You must independently verify safety and appropriateness of all techniques for your patients
    • You agree to indemnify and hold harmless Addison Chiropractic & Kinesiology PLLC from any claims arising from your clinical practice
  4. Information provided does not create a doctor-patient relationship between instructors and students or their patients

  5. Completion of courses does not guarantee certification, licensure, or clinical competence

  3. Alternative Delivery: In the event a live seminar cannot be conducted as scheduled, we may:

    • Change to alternative venue
    • Deliver content via virtual/online format
    • Provide recorded content with equivalent educational value
  4. Student Travel Expenses: We are not responsible for any travel expenses incurred by students, including:

    • Airline tickets
    • Hotel reservations
    • Rental cars or transportation
    • Meals or other travel costs
    • Lost wages or opportunity costs
  5. Refund Options for Major Changes: If we cancel a seminar entirely or make substantial changes (more than 30 days rescheduling), students may choose:

    • Full refund (minus 10% administrative fee), OR
    • Transfer to alternative date/location, OR
    • Credit toward future courses
  6. Minor Changes: Minor schedule adjustments (less than 2 hours), venue changes within the same metropolitan area, or instructor substitutions do not qualify for refunds

  7. Student Notification: We will notify enrolled students of schedule or venue changes via email as soon as reasonably possible

  8. Student Responsibility: Students are responsible for monitoring email communications and confirming seminar details before making travel arrangements

Professional Disclaimer

  1. Course content is for educational purposes only

  2. Information provided does not constitute medical advice

  3. Students are responsible for complying with their own professional licensing requirements

  4. Completion of courses does not guarantee certification or licensure

  5. Students must independently verify applicability to their practice and jurisdiction

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, United States of America.

Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Texas.

Dispute Resolution and Arbitration

  1. Informal Resolution: Before initiating arbitration, parties agree to attempt informal resolution by contacting [email protected] with a detailed description of the dispute

  2. Binding Arbitration: Any dispute, claim, or controversy arising from or relating to these Terms and Conditions or our services shall be resolved by binding arbitration rather than in court, except:

    • Small claims court disputes (under $10,000)
    • Intellectual property disputes
    • Injunctive relief for violations of IP rights
  3. Arbitration Rules: Arbitration shall be conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA) in effect at the time

  4. Arbitration Location: Arbitration shall take place in Collin County, Texas, or remotely via video conference

  5. Arbitrator Authority: The arbitrator may award the same damages and relief as a court, but only to the individual party seeking relief

  6. No Class Actions: You agree that disputes will be resolved on an individual basis only. You waive any right to bring claims as a class action, collective action, or representative proceeding

  7. Costs: Each party bears their own arbitration costs unless the arbitrator awards costs to the prevailing party

Class Action Waiver

YOU AND ADDISON CHIROPRACTIC & KINESIOLOGY PLLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

If this class action waiver is found unenforceable, the arbitration agreement above shall be null and void.

Email and Commercial Communications

  1. By purchasing or enrolling in our services, you consent to receive:

    • Transactional emails (receipts, confirmations, course updates)
    • Educational content related to your purchased courses
    • Marketing communications about future courses and offerings
  2. You may opt out of marketing communications at any time by:

    • Clicking "unsubscribe" in any marketing email

    • Updating preferences in your account settings
  3. Opting out of marketing communications does not opt you out of essential transactional emails

Severability
